Terms of Service.

These Terms of Service ("Terms") cover your use of slopegrandpa.com and any purchase you make from Slope Grandpa ("we", "us"). By using the site or placing an order, you agree to these Terms. Please read them. They include a binding arbitration agreement and class action waiver (section 19).

1. Who we are

Slope Grandpa is owned and operated by Anthony Trutanich ("we", "us"). Orders, payments and fulfillment are processed by Shopify and our suppliers.

2. Eligibility

You must be 18 or older to place an order, or have a parent or guardian place it for you.

3. Prices and errors

Prices are in US dollars and shown on the site and at checkout. If an order has a pricing error or an item turns out to be unavailable, we may cancel the order, and if we do we will refund what you paid for the cancelled items.

4. Payment

Payment is taken through Shopify checkout, using the methods offered there. We do not see or store your full card details.

5. Shipping, title and risk

Shipping is free on every order. Delivery estimates are estimates, not guarantees. Title to and risk of loss for your order pass to you when we hand it to the carrier. See our Shipping Policy.

6. All sales final

All sales final. If your order arrives damaged, defective, or the wrong style, or never shows up, email us within 14 days of delivery (or of the expected delivery date) with your order number and a photo and we'll replace it. Other than that, we do not accept returns or exchanges and do not give refunds.

7. Chargebacks

If something is wrong with your order, please contact us first so we can fix it. If you file a chargeback or payment dispute instead, we will provide proof of delivery and order details to your card issuer.

8. Novelty product

Slope Grandpa masks are novelty costume items. They are not protective equipment. They are not a helmet or a face shield, and they are not rated or tested for impact, cold-injury or UV protection. They do not replace proper ski, snowboard or winter gear. Wear them at your own risk.

9. Use and fit

Check the fit before use and make sure you can see and breathe comfortably. Remove the mask if it is uncomfortable, too tight, or makes it hard to see or breathe. Not for children under 8 without adult supervision.

10. Prohibited use

Do not use the masks to hide your identity to commit a crime, to harass anyone, or to impersonate a real person. Follow resort rules and local laws on face coverings.

11. Assumption of risk

Skiing, snowboarding and sledding are risky activities. You take part at your own risk and are responsible for your own safety equipment and conduct.

12. Product images

Product images and colors may vary slightly from the item you receive, and the printed design may vary between production batches.

13. Our content

The Slope Grandpa name, logo and the content on this site belong to us. You may not copy or reuse them without our permission. The faces printed on the masks are not affiliated with or meant to depict any real person.

14. Your posts and tags

If you tag us on social media, we may repost your content with credit. If you want us to take it down, contact us and we will remove it.

15. No warranties

To the extent the law allows, the products and this site are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Our only commitment for faulty or missing orders is the replacement in section 6.

16. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, and our total liability for any claim relating to an order or this site is limited to the amount you paid for that order.

17. Indemnity

You agree to defend and hold us harmless from claims, losses and costs (including reasonable attorneys' fees) arising from your misuse of the products, your breach of these Terms, or your violation of any law or the rights of others.

18. Changes

We may update these Terms from time to time. The date at the top shows the latest version. The Terms in effect when you place an order apply to that order.

19. Arbitration and class action waiver

Please contact us first; most issues can be sorted out quickly. If we cannot resolve a dispute informally, you and we agree to resolve it by binding individual arbitration rather than in court, except that either of us may bring an individual claim in small claims court if it qualifies. You and we waive any right to a jury trial and to bring or join a class, collective or representative action. You may opt out of this arbitration agreement within 30 days of your first order by sending us a written opt-out notice through our contact form with your name and order number.

20. Governing law

These Terms are governed by the laws of the state where the owner resides, without regard to its conflict-of-law rules.
